This paper argues against the common justification for the necessity of the state through the particular difficulty of private property right. Instead, I argue that the necessity of the state is internal to the concept of right in general. In order to show this, I point out how Kants adoption of hylomorphic language for the concept of right, where there is a formal and material aspect of right, allows us to understand the Rechtslehre as progressing through a syllogistic deduction from (...) innate right (major), private right (minor) to public right (conclusion). Material right is made necessary through its subsumption under formal right in the civil condition. (shrink)

Various approaches have emerged over the last several decades to meet the challenges and complexities of anticipating and responding to the potential impacts of emerging technologies. Although many of the existing approaches share similarities, they each have shortfalls. This paper takes as the object of its study Anticipatory Ethics for Emerging Technologies (ATE) to technology assessment, given that it was formatted to address many of the privations characterising parallel approaches. The ATE approach, also in practice, presents certain areas for retooling, (...) such as how it characterises levels and objects of analysis. This paper results from the work done with the TechEthos Horizon 2020 project in evaluating the ethical, legal, and social impacts of climate engineering, digital extended reality, and neurotechnologies. To meet the challenges these technology families present, this paper aims to enhance the ATE framework to encompass the variety of human processes and material forms, functions, and applications that comprise the socio-technical systems in which these technologies are embedded. ABSTRACT This article examines the under-researched figure A.W. Rehberg in his exchange with Kant over the relationship between theory and practice in the philosophy of right. I argue that Rehberg raises, what I call, two problems of political matter which attempt to show that Kant's overly formal approach to political theory cannot justifiably determine political practice. The first problem is the problem of positive determinations of right, rather than merely negative prohibitions. Rehberg takes this to mean that Kant cannot determine (...) us to a specific form of constitution. I argue that Kant's innovation of intelligible property functions as a response to this critique in that it provides the possibility of synthetic propositions of right a priori. Second, Rehberg insists that an a priori system of right cannot relate to already formed historical communities. Here Kant's response comes close to agreeing with Rehberg as Kant takes prudential or historical reasoning to harmonize with the demands of a priori right in order to applied to the sensible world. Kant, in this instance, comes closer to Rehberg by denying centralized enlightened monarchy and the reliance on natural and historical development for the application of right. (shrink)

Pereira’s “The Projective Theory of Consciousness” is an experimental statement, drawing on many diverse sources, exploring how consciousness might be produced by a projective mechanism that results both in private selves and an experienced world. Unfortunately, pulling together so many unrelated sources and methods means none gets full attention. Furthermore, it seems to me that the uncomfortable breadth of this paper unnecessarily complicates his project; in fact it may hide what it seeks to reveal. If this conglomeration of diverse sources (...) and methods were compared to trees, the reader may feel like the explorer who cannot see the forest for the trees. Then again, it may be the author who is so preoccupied with foreground figures that the everpresent background is ultimately obscured. (shrink)

This article examines an appendix to the Doctrine of Virtue which has received little attention. I argue that this passage suggests that Kant makes it a duty, internal to his system of duties, to ‘join the graces with virtue’ and so to ‘make virtue widely loved’ (MM, 6: 473). The duty to make virtue widely loved obligates us to bring the standards of respectability, and so the social graces, into a formal agreement with what morality demands of us, such that (...) the social graces give the illusion of virtue. The existence of such a duty can answer Schiller’s persistent objection that Kant’s ethics scares away the Graces with Duty. (shrink)

Whether and to what extent Ernst Cassirer’s philosophy of culture contains a normative element for the proper evaluation of symbolic forms is a central question in Cassirer interpretation. In this paper, my aim is to specify the nature of this normative element. I not only assert the existence of a real normative dimension in the philosophy of culture, but also specify the nature of its main element: the concept of freedom. The concept of freedom in Cassirer is by no means (...) an explicit facet of his systematic thought. However, this does not indicate that this is not an important part of his system. Rather, it might mean that Cassirer either thought it so basic he didn’t need to explicate it or he thought that it would be made clear through his exposition of symbolic forms. I will proceed by arguing for a “normative space” in Cassirer’s philosophy of culture. By “normative space” I mean a certain limitation to the philosophy of culture that makes room for the free act of the cultural agent for which she is responsible. In other words, by “normative space” I mean to suggest that Cassirer meant to leave room, and a prominent seat, for the normative element in the philosophy of culture. After establishing this, I will suggest that this normative task in the philosophy of culture is, from a first-person perspective, inevitably connected to the descriptive task, but from a third-person perspective, conceptually distinct. I will then move to better define what I take to be the main value of the normative task: freedom. The freedom that Cassirer defends is an ethical conception understood as both a constitutive norm for cultural action and a regulative ideal for the evaluation of cultural objects. Understanding freedom in this way allows us to conceive of it both as a fundamental phenomenon and an evaluative standard. (shrink)

This is an important collection in that it fleshes out the vague postulate of panpsychism with a detailed analysis of how it might be understood (if not exactly what it might mean). For the many skeptics who simply dismiss the very idea as ridiculous, there is much here to demonstrate that a good deal of serious thought has gone into this ancient proposal. There are many ways to interpret panpsychism, and they are well represented in this group of philosophers, each (...) speaking for a unique take on the subject or one of its variations– from cosmopsychism to panprotopsychism to panexperientialism to neutral monism, etc. The combination problem is fully interrogated, as is panpsychism associated with dualism, idealism, physicalism, theism, etc. Anyone reading this book is bound to gain some respect for the complexity of such subject matter and the compelling logic for approaching it. In Beyond Physicalism, an interdisciplinary group of physical scientists, behavioral and social scientists, and humanists from the Esalen Institute’s Center for Theory and Research argue that physicalism must be replaced by an expanded scientific naturalism that accommodates something spiritual at the heart of nature.

Significant associations have been found between specific human leukocyte antigen (HLA) alleles and organ transplant rejection, autoimmune disease development, and the response to infection. Traditional searches for disease associations have conventionally measured risk associated with the presence of individual HLA alleles. However, given the high level of HLA polymorphism, the pattern of amino acid variability, and the fact that most of the HLA variation occurs at functionally important sites, it may be that a combination of variable amino acid sites shared (...) by several alleles (shared epitopes) are better descriptors of the actual causative genetic variants. Here we describe a novel approach to genetic association analysis in which genes/proteins are broken down into smaller sequence features and then variant types defined for each feature, allowing for independent analysis of disease association with each sequence feature variant type. We have used this approach to analyze a cohort of systemic sclerosis patients and show that a sequence feature composed of specific amino acid residues in peptide binding pockets 4 and 7 of HLA-DRB1 explains much of the molecular determinant of risk for systemic sclerosis. In this paper, I show that we should understand the direction of fit of beliefs and desires in normative terms. After rehearsing a standard objection to Michael Smith’s analysis of direction of fit, I raise a similar problem for Lloyd Humberstone’s analysis. I go on to offer my own account, according to which the difference between beliefs and desires is determined by the normative relations such states stand in. I argue that beliefs are states which we have reason to (...) change in light of the world, whereas desires are states that give us reason to change the world. After doing this, I show how the view avoids various objections, including two from David Sobel and David Copp. The paper ends by briefly discussing the relevance of the view to the Humean theory of motivation. The rapid expansion of Big Tech companies into various societal domains (e.g., health, education, and agriculture) over the past decade has led to increasing concerns among governments, regulators, scholars, and civil society. While existing theoretical frameworks—often revolving around privacy and data protection, or market and platform power—have shed light on important aspects of Big Tech expansionism, there are other risks that these frameworks cannot fully capture. In response, this editorial proposes an alternative theoretical framework based on the notion of sphere (...) transgressions, which draws on political philosopher Michael Walzer's theory of justice. The editorial not only introduces the sphere transgressions framework, but it also highlights its potential to generate novel research questions. Furthermore, this editorial introduces eight articles and one commentary from a group of interdisciplinary scholars that critically examine Big Tech expansionism by reflecting on this expansionism from the perspective of different societal spheres or by engaging with the sphere transgressions framework itself. Linguistic intuitions are a central source of evidence across a variety of linguistic domains. They have also long been a source of controversy. This chapter aims to illuminate the etiology and evidential status of at least some linguistic intuitions by relating them to error signals of the sort posited by accounts of on-line monitoring of speech production and comprehension. The suggestion is framed as a novel reply to Michael Devitt’s claim that linguistic intuitions are theory-laden “central systems” responses, rather (...) than endorsed outputs of a modularized language faculty (the “Voice of Competence”). Along the way, it is argued that linguistic intuitions may not constitute a natural kind with a common etiology; and that, for a range of cases, the process by which intuitions used in linguistics are generated amounts to little more than comprehension. Joel Pust has recently challenged the Thomas Reid-inspired argument against the reliability of the a priori defended by Alvin Plantinga, Nicholas Wolterstorff, William Alston, and Michael Bergmann. The Reidian argument alleges that the Cartesian insistence on the primacy of a priori rationality and subjective sensory experience as the foundations of epistemic justification is unwarranted because the same kind of global skeptical scenario that Cartesians recognize as challenging the legitimacy of perceptual beliefs about the external world also undermine the reliability (...) of a priori rationality. In reply, Pust contends that some a priori propositions are beyond doubt and that fact can be used to support the overall reliability of reason. This paper challenges Pust’s argument. I argue that while Pust successfully undermines a radical skeptical view of reason, he does not refute a more modest skepticism. I conclude with some suggestions for Cartesian a priorists. (shrink)

I start with some famous comments by the philosopher (psychologist) Ludwig Wittgenstein because Pinker shares with most people (due to the default settings of our evolved innate psychology) certain prejudices about the functioning of the mind and because Wittgenstein offers unique and profound insights into the workings of language, thought and reality (which he viewed as more or less coextensive) not found anywhere else. The last quote is the only reference Pinker makes to Wittgenstein in this volume, which is most (...) unfortunate considering that he was one of the most brilliant and original analysts of language. -/- In the last chapter, using the famous metaphor of Plato’s cave, he beautifully summarizes the book with an overview of how the mind (language, thought, intentional psychology) –a product of blind selfishness, moderated only slightly by automated altruism for close relatives carrying copies of our genes--works automatically, but tries to end on an upbeat note by giving us hope that we can nevertheless employ its vast capabilities to cooperate and make the world a decent place to live. -/- Pinker is certainly aware of but says little about the fact that far more about our psychology is left out than included. Among windows into human nature that are left out or given minimal attention are math and geometry, music and sounds, images, events and causality, ontology (classes of things), dispositions (believing, thinking, judging, intending etc) and the rest of intentional psychology of action, neurotransmitters and entheogens, spiritual states (e.g, satori and enlightenment, brain stimulation and recording, brain damage and behavioral deficits and disorders, games and sports, decision theory (incl. game theory and behavioral economics), animal behavior (very little language but a billion years of shared genetics). Many books have been written about each of these areas of intentional psychology. The data in this book are descriptions, not explanations that show why our brains do it this way or how it is done. How do we know to use the sentences in their various way (i.e., know all their meanings)? This is evolutionary psychology that operates at a more basic level –the level where Wittgenstein is most active. This is not a perfect book, but it is unique, and if you skim the first 400 or so pages, the last 300 (of some 700) are a pretty good attempt to apply what's known about behavior to social changes in violence and manners over time. The basic topic is: how does our genetics control and limit social change? Surprisingly he fails to describe the nature of kin selection (inclusive fitness) which explains much of animal and human social life. He (...) also (like nearly everyone) lacks a clear framework for describing the logical structure of rationality (LSR—John Searle’s preferred term) which I prefer to call the Descriptive Psychology of Higher Order Thought (DPHOT). He should have said something about the many other ways of abusing and exploiting people and the planet, since these are now so much more severe as to render other forms of violence irrelevant. Extending the concept of violence to include the global long term consequences of replication of someone’s genes, and having a grasp of the nature of how evolution works (i.e., kin selection) will provide a very different perspective on history, current events, and how things are likely to go in the next few hundred years. One might start by noting that the decrease in physical violence over history has been matched (and made possible) by the constantly increasing merciless rape of the planet (i.e., by people's destruction of their own descendants future). Pinker (like most people most of the time) is often distracted by the superficialities of culture when it’s biology that matters. In ‘Godel’s Way’ three eminent scientists discuss issues such as undecidability, incompleteness, randomness, computability and paraconsistency. I approach these issues from the Wittgensteinian viewpoint that there are two basic issues which have completely different solutions. There are the scientific or empirical issues, which are facts about the world that need to be investigated observationally and philosophical issues as to how language can be used intelligibly (which include certain questions in mathematics and logic), which need to be decided by looking at (...) how we actually use words in particular contexts. When we get clear about which language game we are playing, these topics are seen to be ordinary scientific and mathematical questions like any others. In "Godel es Way" diskutieren drei namhafte Wissenschaftler Themen wie Unentschlossenheit, Unvollständigkeit, Zufälligkeit, Berechenbarkeit und Parakonsistenz. Ich gehe diese Fragen aus Wittgensteiner Sicht an, dass es zwei grundlegende Fragen gibt, die völlig unterschiedliche Lösungen haben. Es gibt die wissenschaftlichen oder empirischen Fragen, die Fakten über die Welt sind, die beobachtungs- und philosophische Fragen untersuchen müssen, wie Sprache verständlich verwendet werden kann (die bestimmte Fragen in Mathematik und Logik beinhalten), die entschieden werden müssen, indem man sich anschaut,wie wir Wörter in bestimmten (...) Kontexten tatsächlich verwenden. Wenn wir klar werden, welches Sprachspiel wir spielen, werden diese Themen als gewöhnliche wissenschaftliche und mathematische Fragen angesehen, wie alle anderen auch. Wittgensteins Einsichten wurden selten übertroffen und sind heute so treffend wie vor 80 Jahren, als er die Blauen und Braunen Bücher diktierte. Trotz seiner Versäumnisse – wirklich eine Reihe von Notizen statt eines fertigen Buches – ist dies eine einzigartige Quelle für die Arbeit dieser drei berühmten Gelehrten, die seit über einem halben Jahrhundert an den blutenden Rändern von Physik, Mathematik und Philosophie arbeiten. Michael Devitt ([2006a], [2006b]) argues that, insofar as linguists possess better theories about language than non-linguists, their linguistic intuitions are more reliable. (Culbertson and Gross [2009]) presented empirical evidence contrary to this claim. Devitt ([2010]) replies that, in part because we overemphasize the distinction between acceptability and grammaticality, we misunderstand linguists' claims, fall into inconsistency, and fail to see how our empirical results can be squared with his position. We reply in this note. Inter alia we argue that Devitt's (...) focus on grammaticality intuitions, rather than acceptability intuitions, distances his discussion from actual linguistic practice. We close by questioning a demand that drives his discussion—viz., that, for linguistic intuitions to supply evidence for linguistic theorizing, a better account of why they are evidence is required. Eu começo com alguns comentários famosos pelo filósofo (psicólogo) Ludwig Wittgenstein porque Pinker compartilha com a maioria de povos (devido às configurações padrão de nosso psychology inata evoluído) determinados preconceitos sobre o funcionamento da mente, e Porque Wittgenstein oferece insights únicos e profundos sobre o funcionamento da linguagem, pensamento e realidade (que ele viu como mais ou menos coextensivo) não encontrado em nenhum outro lugar. Ore é apenas referência a Wittgenstein neste volume, que é mais lamentável, considerando que ele foi (...) o mais brilhante e original analista de linguagem. No último capítulo, usando a famosa metáfora da caverna de Platão, ele lindamente resume o livro com uma visão geral de como a mente (linguagem, pensamento, psicologia intencional)-um produto de egoísmo cego, moderado apenas ligeiramente por altruísmo automatizado para fechar parentes carregando cópias de nossos genes (inclusive fitness)--funciona automaticamente, mas tenta terminar em uma nota otimista, dando-nos esperança de que podemos, no entanto, empregar suas vastas capacidades para cooperar e tornar o mundo um lugar decente para viver. Este não é um livro perfeito, mas é único, e se você desnatado o primeiro 400 ou assim páginas, o último 300 (de alguns 700) são uma tentativa muito boa para aplicar o que é conhecido sobre o comportamento de mudanças sociais na violência e maneiras ao longo do tempo. O tema básico é: como o nosso controle genético e limitar a mudança social? Surpreendentemente, ele não descreve a natureza da seleção de parentes (aptidão inclusiva), o que explica grande parte (...) da vida social animal e humana. Ele também (como quase todos) carece de um quadro claro para descrever a estrutura lógica da racionalidade (LSR — termo preferencial de John Searle) que eu prefiro chamar a psicologia descritiva do pensamento de ordem superior (DPHOT). Ele deveria ter dito algo sobre as muitas outras maneiras de abusar e explorar as pessoas e o planeta, uma vez que estes são agora muito mais graves para tornar outras formas de violência quase irrelevante. Estender o conceito de violência para incluir as conseqüências globais a longo prazo da replicação dos genes de alguém, e ter um entendimento da natureza de como a evolução funciona (ou seja, a seleção de parentes) fornecerá uma perspectiva muito diferente sobre a história , eventos atuais, e como as coisas são susceptíveis de ir nas próximas centenas de anos. Se a sociedade continua a manter os direitos humanos como primários, a seus descendentes pode-se dizer com confiança "WTHOE". Abstract. On the Direct Reference thesis, proper names are what I call ‘genuine terms’, terms whose sole semantic contributions to the propositions expressed by their use are the terms’ semantic referents. But unless qualified, this thesis implies the false consequence that sentences containing names that fail to refer can never express true or false propositions. (Consider ‘The ancient Greeks worshipped Zeus’, for instance.) I suggest that while names are typically and fundamentally used as genuine terms, there is a small class (...) of names, which I call ‘descriptive names’, whose reference is fixed by commonly associated definite descriptions, and I also suggest that there is an idiom of natural language on which such names can be used as abbreviated definite descriptions in a limited set of sentential contexts, including (1) positive and negative existentials, (2) cognitive ascriptions, and (3) uses of names to talk about myth. Uses of empty descriptive names in such contexts can then be either true or false. Relying on Gregory Currie’s theory of truth in fiction, I also propose an idiom on which fictional names can be used as short for a certain type of description in talk about fiction. Along the way, I provide arguments that names are used as short for descriptions in substantive existential statements as well as in both metamythic and metafictive contexts. I also discuss and criticize alternative views of these matters, including the views of David Braun, Saul Kripke, Peter van Inwagen, and others. (shrink)

As an idea, transhumanism has received increasing attention in recent years and across numerous domains. Despite presidential candidates such as Zoltan Istvan, who ran on an explicitly Transhumanist platform in 2016 but later dropped out to endorse Hillary Clinton, transhumanism has taken root more recently in the conspiratorial imaginations of the dark web. Given the philosophy’s central emphasis on technology as an inherent good, imaginations in supposed alt-right internet circles have criticised it as an ideological gateway to global, fully-automated Communism. (...) This is not to say that such discussions on transhumanism are exclusively siloed and on the margins of society. Related discussions are happening at various well-known institutions and research centres such as the Institute for Ethics and Emerging Technologies, a non-profit think tank dedicated to techno-progressivism where I have been managing director for half a decade. What I mean to say here is that transhumanism is not monolithic. It is best described as multi-faceted and existing in different instantiations across multiple domains. James Michael MacFarlane’s recent book, Transhumanism as a New Social Movement: The Techno- Imagination, is an attempt to trace the history, meaning, and practices that characterise this variegated term. Though this volume is a bit dated, there are few recent popular books dealing specifically with the psychology of murder and it’s a quick overview available for a few dollars, so still well worth the effort. It makes no attempt to be comprehensive and is somewhat superficial in places, with the reader expected to fill in the blanks from his many other books and the vast literature on violence. (2015) p 26, 96–97,223, 293-4, 300, 309–312, 410 and Shackelford and Hansen, The Evolution of Violence (2014) He has been among the top evolutionary psychologists for several decades and covers a wide range of behavior in his works, but here he concentrates almost entirely on the psychological mechanisms that cause individual people to murder and their possible evolutionary function in the EEA (Environment of Evolutionary Adaptation—i.e., the plains of Africa during the last million years or so). -/- Buss starts by noting that as with other behaviors, ‘alternative’ explanations such as psychopathology, jealousy, social environment, group pressures, drugs and alcohol etc. do not really explain, since the question still remains as to why these produce homicidal impulses, i.e., they are the proximate causes and not the ultimate evolutionary (genetic) ones. As always, it inevitably boils down to inclusive fitness (kin selection), and so to the struggle for access to mates and resources, which is the ultimate explanation for all behavior in all organisms. Sociological data (and common sense) make it clear that younger poorer males are the most likely to kill. He presents his own and others homicide data from industrialized nations, and tribal cultures, conspecific killing in animals, archeology, FBI data and his own research into normal people's homicidal fantasies. Much archeological evidence continues to accumulate of murders, including that of whole groups, or of groups minus young females, in prehistoric times. -/- After surveying Buss’s comments, I present a very brief summary of intentional psychology (the logical structure of rationality), which is covered extensively in my many other articles and books. -/- Those with a lot of time who want a detailed history of homicidal violence from an evolutionary perspective may consult Steven Pinker’s ‘The Better Angels of Our Nature Why Violence Has Declined’(2012), and my review of it easily available on the net and in two of my recent ebooks. Briefly, Pinker notes that murder has decreased steadily and dramatically by a factor of about 30 since our days as foragers. So, even though guns now make it extremely easy for anyone to kill, homicide is much less common. Pinker thinks this is due to various social mechanisms that bring out our ‘better angels’, but I think it’s due mainly to the temporary abundance of resources from the merciless rape of our planet, coupled with increased police presence, with communication and surveillance and legal systems that make it far more likely to be punished.
